Terms and Conditions [ Crimson Cashmere - Luxury Cashmere Online Shop

The following general terms and conditions of sale govern the online sales of Crimson Cashmere products between the company, Crimson Cashmere, located at 8 Rue Marbeuf, 75008, Paris France, registered with the French trade register under the following number 415 174 497 RCS Paris, and an individual (non-commercial) final purchaser.

The resale of products purchased online is strictly forbidden.

Placing an order implies complete and full acceptance of these general terms and conditions of sale which are accessible at all times on www.crimson-cashmere.com and made prominent at the time of accepting the order. The general terms and conditions of sale constitute the only agreement between the parties and override any other agreement. If a condition is not available in this agreement, the general customs of France’s mail order selling industry would determine this condition.

Prices and VAT

All prices are indicated in Euros (€ ) and inclusive of VAT as applicable on the day of purchase. Any change in the VAT rate will be reflected on product's prices. The prices indicated are exclusive of delivery costs.

For orders delivered to DOM TOM or outside the European Union:
The purchaser will be responsible for clearing his goods through customs by paying the appropriate customs duties and taxes. These duties or taxes are not Crimson Cashmere's responsibility. The purchaser has a responsibility to declare the goods and pay the appropriate duties and taxes to the relevant authorities.

The products ordered by the purchaser will remain the property of Crimson Cashmere until Crimson Cashmere has received full payment.

Confirmation of Orders

To enable us to process your order, you will be asked to read and accept these terms and conditions and will be required to select the "confirm" option at the end of the ordering process. This confirmation constitutes an electronic signature, which has the same value as a handwritten signature between the customer and Crimson Cashmere. Confirmation of your order will be taken as proof of your acceptance of these general terms and conditions of sale. All data saved by Crimson Cashmere will be taken as proof of the transaction between Crimson Cashmere and its customers.

Availability of Products

We endeavour to ensure availability on all our products, however availability cannot be guaranteed. In the unlikely event that your chosen item is unavailable, we will inform you as soon as possible and provide you with the option to order a different item or to cancel your order.

The products listed on this website and the products available in the Crimson Cashmere boutique may differ at any given time.

Presentation of Products

Although Crimson Cashmere has made every effort to display our products and their colors as accurately as possible, the displayed colors of the products will depend upon the monitor of the user, and Crimson Cashmere cannot guarantee that the user's monitor will accurately portray the actual colors of the products.

Product prices are subject to change.
Crimson Cashmere is not responsible for typographical errors regarding price or any other matter.

Payment Security & Methods

All transactions are completely confidential and carried out in a secured environment. We use one of the most reliable secure payment systems available on the Internet: the SSL (Secure Socket Layer) protocol via our partner OGONE. All of your credit card details are protected and encrypted before they are sent for processing and are never kept on our website. Your credit card is debited at the time of the secured transaction in the currency of the order.

You can pay online with your credit or debit card: Carte Bleue, Visa, Eurocard/Mastercard, American Express.
We do not accept cheques, cash or other methods of payment for online transactions.

Delivery

Crimson Cashmere’s preferred delivery partner is UPS. UPS undertakes to deliver purchases made on Crimson Cashmere’s website to any destination worldwide in 24 hours and provides customers with an online facility to track orders. The cost of your UPS delivery will be calculated according to their latest pricelist and the total weight of your purchase. The delivery price will be specific to your order and cannot be calculated before you have confirmed the details of your purchase.

A standard delivery option is also available for 14 European countries though La Poste. The delivery times for this standard service range from 3 to 8 days. The costs for the Standard Delivery service are:

Times required for delivery are given as an indication and could be slightly different in periods of high demand, particular in December. Be assured that we will however do our very best to maintain these time delays and satisfy all our customers.

Delivery may occur in the event of an agreement from the customer (in the order form), from the OGONE payment centre and from Crimson Cashmere. Crimson Cashmere reserves the right to cancel any order placed by a customer with whom it has a dispute concerning a current or prior order.

Crimson Cashmere cannot accept an order where a P.O. Box is given as the delivery address.

Crimson Cashmere could not be held responsible for direct or indirect consequences of the cancellation of an order or a delay in the delivery for any reasons whatsoever, in particular in the event of a strike of the postal services or transports in general. The times for delivery are given as an indication only and should they be longer, this is not a valid reason to claim damages, refuse delivery or cancel the order.

Refunds & Returns

If you are not satisfied with an item, send us notification by email to commande@crimson-cashmere.com, stating your order confirmation number and send the parcel back to us within 15 days of the delivery date in its original condition and packaging together with the original receipt. We recommend that you send it by registered post as we may not be responsible for any lost or unreturned items.

For countries outside the European Union, please remember to indicate to the customs that this a "return for non conformity".
You can ask for a full refund of the value of the item returned or request an exchange.
If you request an exchange, please indicate the replacement item in your email notification. If you request an exchange, delivery of the replacement item will be free.

All refunds will be transacted within 15 days of the return of the item. For a refund, please provide your credit card details in your notification email, by phone, or clearly typed or written on paper, enclosed with your returned item.

Personal Data Protection

Your personal data is required to process your order and at no time is it destined for sale, commercialization or hiring out to third parties. Your personal data remains confidential. Personal data will be only used by our services to process your order and communicate with you by mail or email.

You have the right to access, modify, rectify and refuse access to the information regarding your personal data in accordance to the "computer data and liberty" Law dated 6 January 1978. You may ask us to do so by writing to us and indicating your email address, first name, surname and address.

All material on the Crimson Cashmere website (including, without limitation, written text, comments, illustrations, images, designs, photographs, logos and trademarks) are and shall remain the exclusive property of Crimson Cashmere. Any other use is constitutive of counterfeit and sanctioned by the Intellectual Property Code. You may not reproduce, by any means or process, totally or in part, distribute, publish, transmit, create derivative works based on the Crimson Cashmere product catalogue, modify or sell any such material contained on this website.

Limitation of Liability

In no event will Crimson Cashmere be liable to any party for any direct, indirect, incidental, special, consequential or punitive damages for use of this website including, without limitation, lost profits or revenues, costs of replacement, loss of opportunity, business interruptions, loss of data or damages resulting from any purchase of its products.

In no event will Crimson Cashmere be liable to any party for any direct, indirect, incidental, special, consequential or punitive damages for use of this website or any hyperlinked websites including, without limitation, lost profits or revenues, costs of replacement, loss of opportunity, business interruptions, loss of data or damages resulting from use of or reliance on the information present, even if Crimson Cashmere has been advised of the possibility of such damages.

Crimson Cashmere does not guarantee or warrant that the site or the information contained on the site are compatible with your systems or will be free of viruses, disabling devices or other code that manifests contaminating or destructive properties. You are responsible for implementing safeguards to protect the security and integrity of your systems.

The products on offer on the Crimson Cashmere website comply with current corresponding French legislation. Photographs are not contractual. Crimson Cashmere cannot be held responsible for errors, especially typographical, or the possible variations in colour between the screen and reality.

Finally, we will not be considered either responsible for nor at fault for any delay or consecutive non-execution of goods resulting from a case of force majeure. Events are defined as force majeure if they meet the conditions defined by the "2me chambre civile de la Cour de cassation".

The party citing force majeure should inform the other party within five days following the happening or the threat of this event. Parties will have to discuss the execution of the order while the case of force majeure is occurring. After a month break under these circumstances, Crimson Cashmere may not process the order and will reimburse the customer.

Severability

If, in any jurisdiction, any of these terms and conditions of sale are held to be unenforceable by a court of competent jurisdiction, such terms and conditions of sale shall be restricted or eliminated to the minimum extent necessary and the remaining terms and conditions of sale shall otherwise remain in full force and effect.

No Waiver

No waiver of any of these terms and conditions of sale shall be deemed a further or continuing waiver of such term or condition of sale or any other term or condition.

Law - Disputes

These general terms and conditions of sale shall be governed by and construed in accordance with the French law.
